1.1. Validus Operandi (“Developer”), a legal entity incorporated abroad (offshore), with headquarters at 1209 Mountain Road Northeast, STE R, Albuquerque, New Mexico 87110, is the holder of the intellectual property rights of the Zyper software, hereinafter simply referred to as “Zyper” or “Software”.
1.2. The individual or legal entity that accesses or uses Zyper, in any way, will be referred to as the “User”.
2.1. This Terms of Use (“Terms”) aims to regulate the use of the binary options robot called Zyper, made available through zyper-bot.com for users worldwide.
2.2. Zyper works exclusively on the Nyrion brokerage.
3.1. By clicking “Agree,” “Accept,” or otherwise electronically expressing agreement, as well as by using the Software, the User declares that they have read, understood, and fully accepted these Terms.
3.2. The Developer reserves the right to modify, alter, or update these Terms at any time, by publishing a new version here. Continued use of the Software after such changes implies full knowledge and acceptance of the new terms.
3.3. If the User disagrees with any provision of these Terms, they must immediately cease using the Software.
4.1. Zyper is available in a free trial version (“free trial”) and in monthly, annual, or lifetime subscription plans, as disclosed on the website.
4.2. The purchase of any plan grants the User a limited, non-exclusive, non-transferable, and revocable license to use Zyper, without transferring ownership or assigning intellectual property rights.
5.1. All intellectual property rights over the Software and its components (source code, design, trademarks, logos, etc.) belong exclusively to the Developer.
5.2. The User is not authorized to perform reverse engineering, decompiling, modifying, or any other procedure that aims to access or alter the source code of Zyper.
5.3. Distribution, commercialization, sublicensing, or sharing of Zyper is prohibited without the express consent of the Developer.
6.1. Zyper is provided through access via the website and operates exclusively on the Nyrion brokerage.
6.2. The User acknowledges that binary options trading involves financial risks and that the results obtained by the Software may vary according to market conditions and individual investment decisions.
6.3. The User is responsible for verifying the legality of using Zyper (and binary options trading) in the country where they are located, relieving the Developer from any responsibility for use in jurisdictions that restrict or prohibit such practice.
7.1. Payment for subscription plans can be made via PIX, credit card, cryptocurrency, or other payment methods provided by the Developer at the time of subscription.
7.2. The Software is offered with a free trial period, allowing the User to evaluate its features before subscribing.
7.3. There is no refund policy after purchasing the plans (monthly, annual, or lifetime). By completing the purchase, the User declares being aware and agreeing that no refunds will be made, precisely because of the availability of the free trial period.
8.1. Zyper does not guarantee profits or specific results, being only a tool for automating binary options trading. The User acknowledges that any financial operation involves risks and may result in capital losses.
8.2. The Developer will not be responsible for any financial losses, direct or indirect damages, lost profits, or moral damages arising from the use or inability to use Zyper.
8.3. Strategies, configurations, and investment decisions are the sole responsibility of the User, who must assess their own risk tolerance and seek professional guidance if needed.
9.1. The Developer does not store financial or banking data of Users. Information is processed in an encrypted manner, and only the User's email is collected for registration and license release purposes.
9.2. Any other information provided by the User will be used exclusively to provide the contracted service, in accordance with applicable data protection laws.
10.1. The Developer provides a support channel via Telegram for answering questions, providing guidance, and addressing any issues related to the Software.
10.2. The support hours and conditions may vary and will be informed to the User in due course.
11.1. These Terms become effective on the date of acceptance by the User and will remain in effect as long as the User uses Zyper.
11.2. The Developer may revoke access to the Software at any time, in the event of violation of these Terms or failure to comply with legal obligations by the User, without generating any right to indemnification or refund.
12.1. These Terms will be governed by the laws of the country where the Developer is registered, and subsidiarily by the international laws applicable to contracts entered into via the internet.
13.1. The invalidity or unenforceability of any clause in these Terms will not affect the other clauses, which will remain in full force.
13.2. These Terms constitute the entire agreement between the parties, prevailing over any conflicting previous agreements.
13.3. The Developer's tolerance of any breach of these Terms will not be construed as a waiver of rights or an alteration of obligations.
